<p>CNA Inquiry Legality PA?<br />
					Hi everyone! I&#8217;m posing this question on behalf of my personal friend who recently got a job working as a CNA at a personal care home in Pennsylvania. Simply put, she was accused of abusing a resident and permanently suspended from her position. The office of the aging in Harrisburg was notified of the instance, pending further investigation. We&#8217;re wondering if there is some sort of protocol that needs to be followed in order to investigate such a claim. We&#8217;re wondering what her options are, if any, and if there is something we can do to help the situation.</p>
<p>This all began a week or so ago when she was bathing a resident woman with dementia. The woman was doing fine for a while, but the water must have shocked her, and she began screaming for my friend to dry her off. She tried to calm the woman down. Meanwhile, a passerby coworker overheard the clamor and peeked in for a moment. She immediately went to her supervisor and filed a complaint, stating that my friend had sprayed the woman in the face in an attempt to shut up her complaining.</p>
<p>Once this complaint had been filed, several other employees were queried regarding my friend&#8217;s character, work ethic, etc. Several had mentioned that my friend made threatening remarks about the residents. One isolated instance involved a separate woman, also with dementia, who wouldn&#8217;t keep her feet up while she was being pushed in a wheelchair. My friend asked her repeatedly to keep her feet up, trying to explain to her that she could get hurt if she put her feet on the ground in front of the wheelchair while it was moving. The person who cited this instance told her superior that she believed my friend was actually threatening the resident with injury if she didn&#8217;t listen. I believe the approximate language my friend used was something along the lines of, &quot;Pick your feet up, Mary, you don&#8217;t want to get hurt, do you?&quot;</p>
<p>I think that her actions are well justified. I&#8217;ve known her for years, and even wrote her letter of reference myself. I know that she would never hurt someone, especially someone as helpless as a disabled resident. Her maternal instincts are exemplary for a girl her age, and I really hate to think that this kind of injustice can be done to someone who tries so hard. </p>
<p>Apparently, her workplace is such that the other girls working there are extremely unprofessional. It&#8217;s like a group of schoolgirls being jealous over something simple like a Coach bag. I don&#8217;t know much about the administration of the care home, but it can reasonably be assumed that there&#8217;s some sort of order there or else they wouldn&#8217;t have remained in business for very long.</p>
<p>My friend&#8217;s residents love her, and she loves her job. Her coworkers may not like her, but she isn&#8217;t there to see them. She&#8217;s just there to do her job. Her superior launched an investigation into her behavior at work, and after consulting enough &#8216;character witnesses&#8217;, they felt that they had enough information to substantiate the claim, and suspended her permanently. Note that not a single person has claimed to have actually seen anything. Everything is based on what someone said about someone else. Is this type of action against an employee legal? Can she take action against her employer? Such a black mark on her record exclusively bans her from ever working in the medical industry again, and she was planning to become and RN in the future.</p>
<p>Any and all legal and practical advice will be greatly appreciated. Does anyone know anything about this? Lawyers? Nurses? Thanks so much!</p>

				The problem with your friend is her education and lack of availability to work in other jobs.  Years ago, I was told by my niece (an RN) that they were eliminating all nurses in hospitals unless they were an RN.   You rarely see a doctors office w/out an RN also.  </p>
<p>So many are forced to work in nursing homes as the only employment they can find.  The pay is not that good and I have been told that many times the work is much harder since they take on some many more tasks than a RN that works in a hospital or doctors office.  </p>
<p>The type of patients that are there and most likely a high percentage have dementia which can be very frustrating, since the patient will never be better but will progress worst over time.  I know 1st hand when my ex-mother in law suffered an aneurysm after a stroke, and after surgery she survived but ended up with short term memory.   In 30 minutes, she could ask you to put her to bed, get her up, go to the bathroom a total of 5 to 10 times and not remember she asked you 2 minutes ago and claim she never said that.  I would become exhausted and frustrated to lift her up and out of her wheelchair, then have her change her mind a few minutes later. </p>
<p>I suspect that many people could get &quot;jaded&quot; after awhile and either give up, do what they want or just get upset due to the constant stress of handling these special people. </p>
<p>Your best course is have her seek out an attorney on her legal rights.   They might be able to get her &quot;name cleared&quot; or other steps she might be able to take.   </p>

During the party, the rock band reveals themselves to be mercenaries, led by William Stranix, a CIA operative, who is in league with Krill to unload all of the ship&#8217;s nuclear warheads. They lock up all of the crew and make preparations to remove the warheads. And Krill remembers Ryback, Stranix sends two of his men to take care of Ryback, only thing is that Ryback took care of them. Upon discovering their bodies, Stranix deduces that Ryback is more than a cook. He then sends Krill to check on him, and Krill discovers that Ryback&#8217;s a NAVY SEAL, who got busted down to a cook after an incident in Panama. And Ryback continues to create trouble for them, so Stranix tries to hunt him down. Along the way, Ryback meets Jordan, a former playmate, who was supposed to entertain at the party but was also forgotten.</p>

<p>America be Invaded by a conventional means of warfare?<br />
					No Nation on Earth has the capability of transporting enough troops material and weapons of siege, initial attack and occupation. AS a Nation we are blessd with Geography. (2) Massive Oceans on both sides. No navy would be able to get within striking distance before our warning nets and satellites picked them up. Our east and west coasts are protected by numerous military installations fully capable of protecting their respective shoreline. No foreign navy has a Carrier Strike force and/or battle group which could not be deterred,stopped or destroyed before reaching US territorial waters. The US navy has multiple carrier based strike forces on both coasts. No navy can take them out sucessfully, Including Russia. However I did say &quot;Conventional&quot;&#8230; An Invading army would be possible to attack and land a small number of forces to any coast under the guise of transport ships, commercial aircraft or inside rebellion. However that force would need to have enough time to deploy defensive and offensive measures before we were able to respond. Even then they would eventually be contained to the areas of landing. Possibly taking and holding either West or East coast strips of land.  These troops would then need to continually have amazing luck and skill in avoiding all countermeasures, attacks and must have the ability to &quot;dig in&quot;. In this day no country, not China, nor N.Korea or Iran has the ability to cross the Atlantic or Pacific with enough material to successfully occupy the nation for any length of time.  If by chance a breakout was imminent, I am sure we would also use systematic, tactical, low yield, low area Nukes. These nukes would leave minimal radiation but destroy all invading vehicles,weapon systems and key electronic equipment, unless shielded from EMP.  </p>
<p>Unless they had massive forces covering their rear, I am positive that the British and French, If needed could come and surround the invading army which by now would be stuck on a narrow strip of East coast.</p>
<p>They would also be unable to attack from Mexico or S.America.   The narrowness of Central America and its rough conditions would stop any modern advanced military from successfully moving through those Areas. If a threat was credible enough we would destroy the Panama Canal forcing them to go around the Cape only to be met and buffeted by our Atlantic and Pacifc Naval Strike forces and Battle Groups.  There are no major roads or thoroughfares which are properly paved to supprt an advancing Invasion force of the size needed to attack our Southern perimeter. </p>
<p>The Northern Border although vast and open would also work against surprise. By the time they were detected coming from the Northern Ice fields of Siberia into Alaska, we could set up proper defense lines and fall back positions well into Canada and stop them their.</p>
<p>Even with the US military at half capacity, volunteer forces would be assembled, along with all National Guard Units. </p>
<p>I wont say Impossible. BUT HIGHLY UNLIKELY AND ALMOST 99% Failure Rate.</p>

				You make good points, but you are assuming that if we were invaded that everything would run smoothly and there would be order and control. This is a fallacy. National Guard units would be spread out thin and without a true sense of tactical proficiency. You&#8217;ve also got to realize that Nation Guard units are much less compitant than normal Army Acitve Duty units. The could be over whelmed easily. This isn&#8217;t to say I have anything against the Nation Guard, this is just fact.</p>
<p> Our actual fighting units are all over seas right now, and will continue to be there for at least 2 years, so it&#8217;d take months to pull them back for a massive counter assault on any forces in America. Britain and France would likely donate troops if possible, but again, that would take months.</p>
<p>Mexico in a barren wasteland and is flat, it&#8217;d be all to easily to invade from the border. I&#8217;m not saying that is probably, I just want to let you know that part.</p>
<p>I would trust the defense of this country to Canada or Mexico&#8217;s Armies, and I don&#8217;t suggest you do.</p>
<p>No country on this planet is truly stupid enough to use any nuclear weapon on America soil, simply because we currently hold the largest number of Intercontinental Ballistic Missiles on Earth. Not even the Soviet Union was that dumb.  </p>
<p>You seem to assume that this would be a big surprise invasion, but chances are, this would be after many months of bombing and ground war in another area of the world. This is most likely to happen in the case of a third World War. Britain, France, Germany, Japan, South Korea, Israel, Italy, and Canada would already have troops abroad fighting, and therefore would not have troops to spare. Actually chances are, we wouldn&#8217;t even really have troops to spare, because we would be the big superpower on the &quot;Allies&quot; side. We&#8217;d have to rely on Army and Marine reserve units to hold off the invaders until either we beat them on our soil, or on theirs forcing a retreat. </p>
<p>Finally, and this is the big thing, you seem to be under the fictional impression the the US Armed forces are unrivaled and cannot be beaten. This is a fallacy. While North Korea, Iran, and other 3rd world countries are far too technologically outclassed to pose a serious threat, that does not mean China or Russia is the same way. China has tech that is about on the same level, and they have an army of something like 60 million. We have roughly 2.5 million troops. Math. We might be good, but we aren&#8217;t invincible. And heaven help us if Russia and China got together, cause Russia has some tech that is slightly better than ours, especially tank wise. Also, Russian troops are trained much harder than ours. </p>
<p>We are LUCKY that we have such good diplomatic and economic relations with these countries, other wise we&#8217;d be in a world of pain.<br />

I don&#8217;t think so, while any invasion of the US would entail a military operation on a scale unheard of so far in human history it certainly isn&#8217;t a 99% failure rate.</p>
<p>for a start your land borders are long, very long, there are thousands of weak points along it and even if you deployed all your regulars and NG to defend them it would still not be enough, (to give you an example of how many men are needed to &#8216;hold&#8217; a line, in Europe during WW2 the allies had nearly 3 million men to hold and use a line of less than 700 miles, so how many to hold the mexican border, or canada or the entire east coast etc) because of the shortage of troops your left with limited options, spread them out across the entire border, but once the attack starts understand there is nothing in reserve, so if you don&#8217;t stop them at the line, then if they get though there is nothing to stop them. as for volunteer units, what would you expect them to be able to do? even if they could bring their own weapons and ammo, it would be no substitute for a trained solider, most of them would be dead within 5 minutes of the first shot being fired, (10,000 rounds fired at the local range isn&#8217;t going to prepare you to defend a position against a Chinese air and armoured assault)<br />
or you can defend in depth, this will require your units to form boxes around key points, in a staggered lined perhaps 20 miles deep but this will leave hundreds of miles of borders undefended. because of the vast scale we are talking about many of these boxes will be virtually on their own, so cut off and surrounded to be destroyed when the enemy decides to.</p>
<p>The tech factor is a good one, but why use an EMP to disable it all when there is a far simpler method.<br />
They simply hack into your systems. Homeland Security released a report last year that stated 90% of all SUCCESSFUL hacks in the last 5 years into NATO and US military and Security Services systems came from China, so they are already in our systems, once in who knows what problems they can or would cause during war.</p>
<p>Once across the border then thanks to the excellent transport links they can go pretty much where they like as fast as they like, you couldn&#8217;t prepare to defend one place because they will simply fix you in position with a limited engagement while the rest take another road and be 100 miles behind you within a few hours. and then your faced with another problem, the sheer vastness of the USA works against you, you simply do not have enough planes to cover every inch of sky, every inch of land, planes could spend hours flying around and never see one thing, all the enemy high value targets have millions of square miles to lose themselves in, <br />
I would expect a resistance movement to begin within hours of any attack, but as we see in Iraq, while it is a hindrance, it doesn&#8217;t actually win wars or stop the machine.<br />
Sure nations may come to help, but this takes time and money, money which will be in short supply globally because of the total breakdown of the American economy due to the war.</p>
<p>There are hundreds of factors still to be listed that make any hypothetical invasion of the US less than a 99% failure rate.</p>
<p>Thankfully such a thing is currently impossible such is the dominance of the US military over everyone else, but who knows? some other countries now have the money and the manufacturing base to start to close the gap at a very fast pace if they decided to.<br />

					This is a long story, but please read it, and please help me, I feel so depressed.<br />
When I was in kindergarden in the States my teacher was very unfair to me and excluded me from many of the activities. She was biased toward the sides of all the American kids, and I was always not of her favor. Later I moved to China, only for a month, to go to a local school. There, the Chinese teachers did not like me at all since I was born in the US. They also excluded me. During that time my parents began to beat me a lot (in China parents are allowed to spank their kids). Then we moved back to the US. In the US, we shifted schools. There, somehow, I became nearsighted. I could not see the board, and when it was time for the annual school health checkup, it turned out that I really was nearsighted. My mom bought an eye-chart and kept on making me read it. Meanwhile my dad moved back to China. During this time, my mom did not let me go to school because I could not read the eye-chart: she was not satisfied till I could read it. Thus, I was often late for school and the teachers were very dissatisfied. After a few years, we moved back to China, and it was there that my parents began to blame me for things that I was not intentionally doing and beating me once more. One thing I remember clearly is an incident that happened when we were in a theater watching a movie. That incident also traces back to the fact that I had cross-bite, and my mom said that the reason for my cross-bite was because my upper lip was too short. So she kept on pulling my upper lip, and making me do all these crazy exercises which really did drive me quite mad because of their stupidity and her beatings after I refused to do them. This caused me to have a habit of pushing my upper-lip up with my thumb, kind of like a rejection to her exercises. That day during the movie, I was pushing my upper-lip again, and my mom saw it. She was very angry and pulled me out of the theater into the hallway. My dad followed us afterwards. There, in the middle of the public&#8217;s eye, they beat me and almost abandoned me their and walked away. Everyone was watching and it was an ultimate embarrassment. The next day I hurt very badly. After that incident they punished me very often for things I did not intentionally do. After a few months there was school. At our school, we had something called &#8216;trip week&#8217;. We went to a place in China for this event, and our teachers, of course, came with us. One night, after watching a performance, we had half an hour to shower because we were late already after the show. After I and my roommate got onto our bed, a teacher knocked on our door shortly and asked us why we were talking. But we weren&#8217;t talking, and that was what I told her. The teacher pursued us until I was very angry and just told her that it might as well be her own fault for not hearing correctly, as we weren&#8217;t talking at all. She was very upset and went away. The next morning the teachers of the trip called I and my roommate downstairs for a meeting. They made I and her apologize for what we did. We apologized, but after the trip and when we went back to school one of the teachers of the trip called me into her office and made me apologize for calling the teacher that night who accused us of talking a &#8216;drunk&#8217; and a &#8216;lier&#8217;. This made sense, the accusing teacher was a new one who did not speak much English. That night I cried a lot and it was the first time I wished I were dead. <br />
What can I do about this? Now, whenever something happens that reminds me of anything depressing that has happened in the pass, everything comes back to me. A lot of the time I consider committing suicide, but then I just turn back. Whenever my mom does something that reminds me of anything she has done that I was once crazed by, I am driven temporarily insane. Any help is appreciated. Please, do not write something like &#8217;serves you right&#8217; or &#8216;I can&#8217;t help you&#8217; like so many other people have told me. Any words of wisdom are appreciated. Thanks a ton beforehand.</p>

				The best advice I can think to offer is to forgive the people who have hurt you so that they don&#8217;t hold this power over you anymore. Whenever we are not at peace in our lives we need to look around and see who we can forgive. You will notice that to do this you have to work through your issues individually, but it will be such a weight off your shoulders. Only you have control over your life and by blaming other people you are forfeiting that control. Also if you want to help yourself you should speak with a professional, your life is precious and it is the only one you will have, please, please find a way to realize that. 				Ok first of all, do not rely on past events to prove why your are not loved. When a person is depressed they construct memories to fit their current mood. Did you ever eat a bunch and then think about eating a donut? If you are full you prolly see how disgusting adding a donut really is. Get my point? Anyways. You need to stop being so pessimistic and start taking things less seriously. That way, you can get out of your mood of being reminded of all the bad things that happen to you. Human beings have a mechanism in their brain which helps them forget bad stuff and make good stuff stand out better. So, if you watch a lot of comedy and think happy thoughts and dont get all emo&#8217;d up in a corner when someone reminds you of something bad that happened to you, you will soon get out of your depression bubble because it is only natural. Stay the hell away from medication and believe that you are better than this. You need all the motivation in the world to do this and feeling bad about yourself is not the answer. Ive been depressed before and I hated alot of people for alot of different things. But time is the best cure and now that I look back at it it wasnt all that bad. The best remedy is meeting new people who are not downers - they really bring you out of your shell. Anyways, best of luck to you, I know you can do this.<br />

				I can empathise with you. Sorry to hear about all the bad times you have been through, i think you&#8217;ll find that depression affects a lot more people than you think, and there is help out there for you. Have you considered going to therapy? Speaking from personal experience i was a bit hesitant at first, but i found it to be very useful, just having someone to tell everything to, someone who will listen without judging you, it&#8217;s their job <img src='http://cybermutt.gibcosta.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> I wish you luck in the future, and no matter how low you feel, i urge you to not take your own life, it really isn&#8217;t worth it. 				You have to remain hopeful and do whatever you can to get away! My mom read a story once about a guy who was being raped repeatedly when he was a kid, when he grew up, he wanted to kill the dude who did it! Instead he met someone, who told him that he could be whatever he wanted in life, and no one could tell him any different! He also told him, that to prove he was better than that person, he must forgive them, but he also included that, just b/c you forgive someone doesn&#8217;t mean you have to stay around and take the abuse. Find what makes you happy, and remember that you&#8217;re not your parents or the teachers, and you have chosen to live a better life! And if they tell you that you&#8217;re acting like you&#8217;re better than them, no that you&#8217;re not, you&#8217;re just making better choices!<br />

				Sir i admire your courage that despite all this SH*T happening to you, you still seek solutions. I have been in the same situation with the parents, at least it was mitigated enough so I overcame it quickly. First off, realize it is not your fault that you have nearsight etc. <br />
Second, if you can sustain yourself financially you should take some time off and leave these problems behind, relax get a grip obtain a comfort zone having friends and girlfriend helps a lot in this case. <br />
Third and most important, prove through example that YOU are a worthy human being and nobody can put you down any more. Make it as a rule for yourself to not be beaten down anymore or made fun of or molested. Respect this rule from the moment you aknowledge it. Do not in any case use aggression towards any party involved you will regret it later.<br />
The punishment for those involved is that you achieved success despite the obstacles instituted by them. Belive me it&#8217;s a worthy punishment.<br />

				You will need therapy, but the ways I suggest have the shortest time, for the most progress, rather than open ended psychotherapy, which can go for years, and cost a small fortune.</p>

Ask others, who were around at the time, and record their more positive memories. </p>

Why not take care of yourself and your family instead of snooping into someone else&#8217;s life.  Obviously you have nothing better to do.  How about worrying about where the tax dollars that people actually pay are going&#8230;  Taxes pay for bailouts, prisons, and people on welfare (amongst other things). 				Quite the contrary to what &quot;Micheal&quot; is saying.The IRS is actually giving out a certain percentage of money to those that &quot;inform&quot; on those not paying taxes.If this person is making that large amount &amp; is not reporting it on their world wide income you could be eligible for up to 15 % of the total or a total maximum of 10 million US.</p>

<p>just need a lil advice to ease my mind?<br />
					so almost 2 weeks ago my daughter went to have a cat scan because it feels like one of the sutures in her head has fused early (sutures are the ends of the skull that fuses later in life) so shes got this hard line going to the back of her head, well now they have set me up with a neurologist to review her scan, and its got me nervous, from what i have read on the net (i know not always the best place) to fix it they will have to do surgery because it can cause the brain to not grow correctly and have some developmental delays (as of right now i cant tell that there are any) but now the more and more i look at her head it kinda seems to be a little bigger in the forehead area, i have included pics for you to kinda look at and give your opinion, but i guess what i want to know is would they have gotten a neuro involved if it wasnt something serious or do they just want a second opinion with a dr that deals with this stuff, i still have to wait another week before we se the neuro so some ease of mind til then would be wonderful thank you</p>

				I think the Neuro involvement is just to make sure all is right and that the right Dr. makes sure of this! They are sending you to the right place, please don&#8217;t worry so much as it is just a precaution. If you think she is having any signs of distress (sleeping more than usual, not being as responsive to stimuli etc) call her Dr. asap. You have a beautiful baby!<br />

				first, your daughter is beautiful!   I would be thankful that they are calling in a neurologist - if there is a problem that needs correcting, it&#8217;s good that it&#8217;s being looked at and dealt with early before it causes any problems for her later.  Of course you don&#8217;t want to think that there&#8217;s anything wrong with your baby girl, but worrying about it won&#8217;t change anything - and she&#8217;ll pick up on your apprehension.  As a mother you want to protect her from everything, but unfortunately there are some things that have to be left up to others to take care of for you. Just shower her with hugs and kisses and try to keep her from picking up on your fears!!  good luck!!<br />
